Terminating a rental agreement

A rental agreement for residential space does not end by the expiration of the agreed rental term.

When can the rent of a residential property be terminated?

Note: a rental agreement for residential space does not end by the expiration of the agreed rental term. The rental agreement is tacitly extended and must therefore be terminated. Termination is not necessary if it concerns a rental agreement for a fixed term.

Depending on who terminates (the tenant or the landlord), the following applies:

Termination of residential space by the tenant

The tenant can terminate the rental agreement for residential space. Under the law, the notice period for the tenant is equal to the rent payment period, with a minimum of one month and a maximum of three months. So, if the rent is paid monthly (which is usual), the notice period is one month. Terminating on December 12 means it takes effect on January 31.

Termination of residential space by the landlord

If it concerns an indefinite-term rental agreement, the landlord can only terminate the rental agreement based on a statutory ground for termination. Examples include poor tenancy, urgent personal use, or the tenant’s refusal to agree to a reasonable offer to enter into a new rental agreement. The landlord must observe important termination formalities. If the tenant does not agree to the termination within six weeks, the rental agreement remains in force. The landlord must then go to court to demand the end of the rental agreement. As a landlord, always consult a rental law specialist promptly when you wish to terminate the residential space.
